YOUR ACCOUNT MANAGER

As soon as you log into the Client Portal, you are assigned an Account Manager. All the contact details for your Account Manager will be available in the Client Portal.  

The role of your Account Manager is to educate and guide you on all the services that we provide as well as ensuring that you have access to these services.  

You will receive an introductory phone call from your Account Manager. During this call your Account Manager will also assess if you need more information about one of our courses if you simply want to open a trading account or if you would like to become one of our Introducing Brokers. All the Account Managers can assist with all 3 of these services.

TECHNICAL SUPPORT TEAM

 We have a team of Support Staff who are on duty 7 days a week during our Support Hours. This team can be accessed easily and quickly through the LiveChat functionality found in the Client Portal. Through this LiveChat you will be able to chat directly with all our various Departments.  

You are also able to log a Help Desk Ticket requesting support. This can be done by logging into the Client Portal. The response time to these tickets will be much slower than the LiveChat response times, please keep this in mind when you decide which channel to use.

Insolvency & Rehabilitation

 An insolvent is a debtor whose estate (everything, including money, that a person owns) is under sequestration. If you are insolvent and want to be rehabilitated (no longer insolvent) within ten years of having been declared insolvent, you can apply to court for rehabilitation.  

What is rehabilitation? 

A person is no longer insolvent when they are rehabilitated. Rehabilitation enables a person who has been sequestrated to make a fresh start, free from pre-sequestration debts and from the restrictions placed on them by the sequestration. 

Automatic rehabilitation after 10 years

An insolvent is automatically rehabilitated 10 years from date of sequestration of their estate. The 10-year period runs from date of provisional sequestration. However, this will not be the case if the court issues an order that the insolvent will not be automatically rehabilitated. Check with a client whether 10 years has elapsed from when they were first sequestrated and whether there were any insolvency declarations within the 10 years. 

There are instances, where an insolvent person can apply for relief before the 10-year period has elapsed. 

  1. An insolvent has obtained a certificate from the Master of the High Court stating that creditors have accepted a settlement of not less than 50c in the rand i.e. half of the debt as settlement. 

 2. An insolvent can apply for rehabilitation after a period of 6 months has lapsed from date of sequestration if: 

  • at the time of making the application, no claim has been lodged against the insolvent’s estate; 
  • the insolvent has not been convicted of any fraudulent act in relation to their insolvency; and 
  • the insolvent’s estate has not been sequestrated before. 

3.At any time after confirmation by the Master of a plan providing for the payment in full of all proved claims with interest calculated in terms of the Act and all the costs of sequestration, the insolvent may apply for rehabilitation. 

4.It is important to note that the court is not obliged to grant rehabilitation. An insolvent does not have a right to rehabilitation and therefore the court has discretion in granting the rehabilitation order. 

In all the cases above, obtain documentary evidence from the client from the Master of the High Court evidencing the rehabilitation. As account is to be declined if 10 years has not passed since the client has been insolvent, or if they cannot produce a document stating that they have been formally rehabilitated. The document is to contain a stamp from the Master of the High Court.
